Trademark search

A preliminary search is conducted to assess whether identical or similar trademarks have already been filed or registered in Myanmar. This helps identify potential conflicts before filing.

Registration procedure

Our trademark registration service includes the following steps:

Preparation of application

We review the trademark details, determine the appropriate class(es) of goods and/or services in accordance with the Nice Classification, and prepare the necessary application documents.

Filing of application

The trademark application is filed electronically with the Intellectual Property Department (IPD) of Myanmar.

Examination

The IPD examines the application to ensure compliance with the Myanmar Trademark Law and applicable regulations.

Publication

If the application is accepted, the trademark is published in the Trademark Journal for opposition.

Registration

If no opposition is filed, or any opposition is successfully resolved in favor of the applicant, the trademark proceeds to registration and a Certificate of Registration is issued by the IPD

Required Documents

Under the Myanmar Trademark Law (2019) and the Trademark Rules, the following documents and information are generally required for filing a new trademark application with the Intellectual Property Department (IPD).
1. Application Form (TM-1)

A duly completed Form TM-1 for the registration of a trademark, containing:

  • Applicant's name and address
  • Nationality and legal status (individual or legal entity)
  • Representation of the trademark
  • Description of the trademark (if applicable)
  • List of goods and/or services according to the Nice Classification
  • Priority claim details (if any)
  • Applicant's or authorized representative's information
2. Representation of the Trademark

A clear representation of the trademark to be registered, which may consist of:

  • Word mark
  • Device/logo
  • Combination mark
  • Three-dimensional mark
  • Colour mark (where applicable); or
  • Other registrable trademark as recognized under the Myanmar Trademark Law
3. List of Goods and/or Services

A specification of the goods and/or services for which protection is sought, classified in accordance with the Nice Classification (12th Edition).

4. Power of Attorney (TM-2)

A duly executed Form TM-2 (Power of Attorney) authorizing a registered Myanmar trademark representative to act before the Intellectual Property Department (IPD).

Notarization or legalization is generally not required unless specifically requested by the Registrar.

5. Priority Documents (if Priority is Claimed)

If the applicant claims priority under the Paris Convention or the WTO Agreement, the following should be submitted:

Priority claim details in the application; and
A certified copy of the earlier application (if requested by the Registrar), together with an English translation where necessary.

The priority claim must be made within six (6) months from the first filing date.

6. Transliteration or Translation (if Applicable)

Where the trademark contains foreign-language words or non-Latin characters, the Registrar may require:

Transliteration;

  1. Translation into English or Myanmar; and/or
  2. Explanation of the meaning of the mark.
7. Supporting Documents (Where Applicable)

Depending on the nature of the application, the Registrar may request additional documents, including:

  1. Evidence of the applicant’s legal status;
  2. Consent letters;
  3. Evidence of acquired distinctiveness;
  4. Disclaimer statements;
  5. Other supporting documents required during examination.
8. Official Filing Fee

The prescribed official filing fee must be paid at the time of filing the application.

Notes

A separate Form TM-1 must be filed for each trademark and each class of goods or services.

The Intellectual Property Department (IPD) may issue an Office Action requesting additional information or documents during the examination process.

All documents submitted in a language other than English or Myanmar may need to be accompanied by a certified translation.
