Trademark General Licence Contract (GLC) Registration

A trademark owner may authorize another party to use its registered trademark through a Trademark General Licence Contract (GLC). To ensure that the licence is recognized by the Intellectual Property Department (IPD) and enforceable against third parties, the licence should be recorded with the IPD in accordance with the Myanmar Trademark Law 2019 and its implementing regulations.

Recording a trademark licence provides legal certainty regarding the relationship between the trademark owner (Licensor) and the licensee and establishes a public record of the licensed rights.

Who May Apply?

An application for the registration (recordal) of a Trademark General Licence Contract may be filed by:

  • The registered trademark owner (Licensor);
  • The Licensee; or
  • An authorized trademark representative acting on behalf of either party.

Requirements

The following documents and information are generally required for recording a Trademark General Licence Contract:

  • A completed application for registration of the Trademark General Licence Contract.
  • A copy of the executed Trademark General Licence Contract signed by both the Licensor and the Licensee.
  • Full names, nationalities (if applicable), and addresses of both parties.

Details of the registered trademark, including:

  1. Registration number;
  2. Trademark representation;
  3. Relevant class(es) of goods and/or services.
  4. The scope of the licence (exclusive, non-exclusive, or sole licence, where applicable).
  5. The goods and/or services covered by the licence.
  6. The term of the licence agreement.
  7. A Power of Attorney (Form TM-2), where the application is filed through a trademark representative.
  8. Payment of the prescribed official fees.

The Intellectual Property Department may request additional information or supporting documents if necessary, during its examination.
